The Appellant, Frank C. Roberts, was charged by affidavit on March 20, 1973, with the crimes of commission of or attempt to commit a felony (robbery) while armed, Ind. Code Â§ 35-12-1-1 (Burns 1975), and infliction of an injury in the commission of or attempt to commit a robbery, Ind. Code Â§ 35-13-4-6 (Burns 1975). On December 3, 1975, he was convicted on both counts. The jury imposed a determinate sentence of twenty-five years for the armed robbery conviction. The Appellant was sentenced to a concurrent sentence of life imprisonment for his second conviction. This appeal is taken from the trial courts denial on August 4, 1976, of a belated motion to correct errors.
